Terms of Use

This English version is a translation provided for convenience. The Hebrew version is the binding one, and it prevails if the two differ.
1. Parties and acceptance
The service is operated by QME ("QME"). A business owner accepts these terms by explicitly ticking a box when signing up. A customer accepts them by sending the verification code, after being shown these terms and the Privacy Policy.
2. The service
QME provides a platform where businesses manage appointments, customers, payments and messages, and customers book and manage their appointments. QME is not a party to the engagement between the business and the customer, and is not responsible for the service the business provides.
3. User account
- You must keep your account access credentials secret and report any unauthorized use to us immediately.
- You may not use the service for illegal activity, harassment, or sending unlawful advertising.
- QME may suspend an account that breaches these terms, after notice, unless immediate action is needed to prevent harm.
- You can delete your account at any time from the settings.
4. Business obligations toward its customers
- The business is the controller of the information it keeps about its customers, and is responsible for the lawfulness of collecting and using it.
- Customer information is entered only when the customer knows about it and for the purpose of providing the service. Do not enter sensitive information that the service does not need.
- Forms that may include medical or other sensitive information are created only when the information is needed for the treatment. The customer will explicitly approve them when filling them in.
- Marketing messages are sent only to customers who have not asked to stop receiving them, subject to the Communications Law (section 30A) and the Protection of Privacy Law. The system labels such messages as "Advertisement" and honors removal requests automatically.
- A request to review, correct or delete information that comes from a customer of the business is handled by the business, and QME will assist it.
- The business is responsible for ensuring that the prices it displays, and the cancellation, deposit and refund policy it sets, comply with the Consumer Protection Law, including the right to cancel a distance transaction.
5. Data processing terms (QME as a holder on behalf of the business)
This section is the agreement between the business and QME under regulation 15 of the Protection of Privacy Regulations (Data Security), 5777-2017:
- The information: details of the business's customers, notes, appointments, payments, session packs, form answers and photos, as well as staff details.
- The purpose: providing the service to the business only. QME will not use the information for any other purpose, will not sell it, and will not pass it to anyone else, except the sub-processors listed in the Privacy Policy.
- The systems: QME servers and the sub-processors listed in the Privacy Policy. The permitted operations are storage, display to the business, sending messages on its behalf, backup and deletion.
- Security: encryption of identifying and sensitive fields, isolation between businesses, role-based permissions, access logging and encrypted backups, at least at the level the regulations require.
- Confidentiality: QME employees and sub-processors have access only to the extent their role requires, and are bound by confidentiality.
- Security incident: QME will notify the business without delay of any security incident that affected its information, and will assist it with its reporting obligations.
- Reporting: on request, and at least once a year, QME will report to the business on how it meets its obligations under the regulations and this agreement.
- Termination: when the business account is deleted, all its information is deleted from the active systems, and from backups in the next backup cycle. Before deletion, the business can export its appointments.
6. Payment and subscriptions
Paid subscriptions are charged in advance. You can cancel at any time; charges stop at the end of the current subscription period. There is no refund for a period already purchased.
7. Liability
QME works to keep the service available and working properly, but is not liable for indirect damage caused by using the service, to the extent the law permits. Nothing in these terms limits liability under the Protection of Privacy Law.
8. Changes to these terms
The version number and update date appear at the top of the page. We will announce any material change in advance and ask for your consent again.
9. Governing law and jurisdiction
These terms are governed by Israeli law. The competent courts of the Tel Aviv district have exclusive jurisdiction.
